Terms of Service
Effective date: [EFFECTIVE DATE]
App: Havara (havara.app)
Provider: [LEGAL ENTITY NAME] ("we", "us", "our")
By creating an account or using Havara (the "Service"), you agree to these Terms.
If you do not agree, do not use the Service.
1. The Service
Havara is a private communication and management platform for residential
communities — chat and direct messages, board notices, events, amenity bookings,
and document sharing. Access to a community is controlled by that community's
administrators.
2. Eligibility & accounts
- You must be at least [18 / 13] years old and able to form a binding contract.
- You are responsible for the accuracy of your account information and for
activity under your account. Keep your credentials secure and notify us of any
unauthorized use at support@havara.app.
- Membership in a community may require approval by that community's
administrators, who may also remove you from the community.
3. Acceptable use
You agree not to:
- Post unlawful, harassing, hateful, defamatory, or infringing content.
- Impersonate others or misrepresent your affiliation.
- Upload malware, attempt to breach security, scrape, or access data you are not
authorized to access.
- Use the Service to send spam or to violate the privacy of other residents.
We may remove content or suspend accounts that violate these Terms or that a
community administrator reports, at our reasonable discretion.
Objectionable content and abusive users — zero tolerance. Havara has zero
tolerance for objectionable content (including content that is offensive,
harassing, threatening, sexually explicit, hateful, or that depicts or incites
violence) and for abusive users. You agree not to post it. Every member has the
tools to act on it:
- Report any message: press and hold it, then choose Report. Reports go
to your community's moderators and to us for review.
- Block any user: from their profile or from one of their messages, choose
Block, and their content is hidden from you everywhere. Manage your list in
Settings → Blocked accounts.
We review reports and **remove objectionable content and eject the users who
post it, typically within 24 hours**. Community administrators also moderate
their own spaces. These tools and this commitment are conditions of using the
Service.
4. Your content
- You retain ownership of content you post. You grant us a limited license to
host, store, transmit, and display it solely to operate the Service for you
and your community.
- You are responsible for the content you post and confirm you have the rights
to post it.
- Content is shared with the audience you choose (community, group, direct
message, or board); see the Privacy Policy for how data is handled.
5. Community administrators
Communities and their administrators control membership, roles, and what is
posted in their spaces, and may retain community records. We are not responsible
for the decisions, content, or conduct of communities or their members.
6. Notifications
With your permission, the Service sends push notifications. You can disable them
at any time in your device settings.
7. Third-party services
The Service runs on third-party infrastructure (including Supabase, Expo, and
Apple, and — for the AI "Ask" feature — OpenAI and Anthropic). Their
availability and terms may affect the Service; we are not responsible for
third-party services.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY
KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not
warrant that the Service will be uninterrupted, secure, or error-free.
AI answers. The "Ask" feature generates answers from your Community's
documents using artificial intelligence. Answers may be incomplete or
inaccurate, are provided for convenience only, and are **not legal, financial,
or professional advice**. The governing documents themselves — not AI summaries
of them — control. Verify anything that matters against the cited source.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, [LEGAL ENTITY NAME] WILL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR
LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY
FOR ANY CLAIM WILL NOT EXCEED [THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN
THE 12 MONTHS BEFORE THE CLAIM].
10. Indemnification
You agree to indemnify and hold harmless [LEGAL ENTITY NAME] from claims arising
out of your content or your violation of these Terms or of any law or third-party
right.
11. Termination
You may stop using the Service and delete your account at any time. We may
suspend or terminate access for violation of these Terms or as needed to protect
the Service or other users.
12. Changes to the Terms
We may update these Terms; we'll revise the "Effective date" and, for material
changes, notify you in the app or by email. Continued use after changes take
effect constitutes acceptance.
13. Governing law & disputes
These Terms are governed by the laws of [STATE/JURISDICTION], without regard to
conflict-of-laws rules. [Dispute resolution / arbitration / venue clause —
confirm with counsel.]
